The tyranny of the audience figures is one which is very hard to overcome, although successive generations of BBC leaders have tried very hard to do this. In a 2010 report for Policy Exchange, entitled gChanging the Channelh, Mark Oliver says the following:

European and national competition authorities should take into account the specific value of media pluralism in the enforcement of competition rules. They should also take into account the increasing merging of different channels of communication and media access in the definition of the relevant markets. In addition, the High Level Group calls upon the European and national competition authorities to monitor with particular attention, under competition policy, new developments in the online access to information. The dominant position held by some network access providers or internet information providers should not be allowed to restrict media freedom and pluralism. An open and non-discriminatory access to information by all citizens must be protected in the online sphere, if necessary by making use of competition law and/or enforcing a principle of network and net neutrality.

Concentration of ownership needs to be considered not only with respect to specific media sources (such as press), but across different media and in relation to distribution channels, whether for traditional media (for example, newspaper kiosks) or for new media (for example, broadband connectivity).

Digital intermediaries, such as search engines, news aggregators, social networks and app stores should be included in the monitoring of the sector. The increasingly important role they play in either improving or restricting media pluralism should be considered, especially as they start producing content. However, care must be taken to distinguish between media that publish original work directly, and services that allow users to republish or link to other peoplesf work.

hLooking at international comparisons, the number of reputable providers of broadcast news and print journalism doesn't seem too unhealthy at present, and of course the internet has broadened the range of available news sources. 

But the problem may be one further down the road, as the market changes. If giants like Google and Apple continue to grow at their current rate they will become more and more powerful and will acquire more and more influence over the way people use different media on a day-to-day basis. They may come to control the so-called 'gateways' that people use to get to news and other programmes.h

 (The third case concerned the Hungarian media law where there were serious concerns, notably about the lack of independence of the new Hungarian media authority from the government. Here, the Commission was faced with the legal situation that the EU has only very minor competences with regard to the media. Press and radio are practically outside the scope of the EU Treaties, as is most media content. Only for the provision of cross-border audiovisual media services, certain minimum rules are included in the Audiovisual Media Services Directive. However, these rules do not include a legal requirement that each Member State establish an independent media regulator. The Commission had proposed such a rule in 2005, on my initiative. However, only Latvia, the Netherlands and the UK supported my proposal, while all other Member States rejected it as an undue interference with their national prerogatives. This is why the Commission could only insist on some marginal changes to the Hungarian media law where these were related to audiovisual media services. On the key issue, the independence of the media authority and its role vis-à-vis the written press, the Commission had no power. Certainly, Article 11 of the Charter provides for freedom of expression, freedom of information and freedom of the media. However, under Article 51 of the Charter, this only applies to national decisions where the Member State implements EU law. This was not the case for most of the articles in the Hungarian media law. One can argue that, even in this case, there was some complementarity between the EU Charter and national fundamental rights - Because, on 19 December 2011, the Hungarian Constitutional Court declared that certain provisions of the Hungarian media law unconstitutionally limited the freedom of the written press. Nevertheless, not all observers of this case were convinced that the matter had been fully resolved and that freedom of the media continues to be fully respected in Hungary. I personally will only trust this complementarity if I am assured that the judiciary in Hungary is and remains fully independent following the recent constitutional changes. The Commission will continue to monitor this very closely.)
