The Court stated that, in so far as trade between Member
States may be affected, such legislation was contrary to Article 86(1) in
conjunction with Article 82 since it created a situation in which the incumbent
undertaking enjoying the exclusive right could not avoid abusing its dominant
position by receiving payment for services which it had not supplied. However,
the Court also held that this restriction of competition, which consisted in
the fact that undertakings operating outside the universal service were obliged
to contribute to the viability of the universal service provider, could be
justified under Article 86(2) if the financial contribution was limited to the
amount strictly necessary to offset any losses which may be incurred by the
incumbent undertaking in the operation of the universal postal service.
